Kinloop is a care management platform operated by sistemafusion, LLC. "Kinloop" is a trade name used by sistemafusion, LLC ("Company," "we," "our," or "us"). By creating a Kinloop account or using our service, you agree to these Terms of Service ("Terms") and our Privacy Policy.
If you are using Kinloop on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Care coordinators on the Kinloop platform provide administrative care coordination only and do not provide clinical services. Always consult a licensed healthcare professional for medical decisions.
You must be at least 18 years old and a resident of the United States to use Kinloop. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@kinloop.co if you suspect unauthorized access.
By adding a care recipient’s phone number to your account, you represent that:
Standard message and data rates may apply. Care recipients can reply STOP at any time to opt out. Opting out will stop SMS delivery but does not cancel your subscription. SMS delivery is not guaranteed and may be affected by carrier filtering, phone availability, or network conditions. Kinloop offers three subscription plans — Basic (USD 29/mo), Premium (USD 79/mo), and Concierge (USD 129/mo) — billed monthly in USD. All prices are before applicable sales tax. Additional care recipients on a single account are available as add-ons at an additional monthly fee.
New accounts receive a 14-day free trial. Your payment method will be charged at the end of the trial unless you cancel before then. You may cancel during the trial at no cost via the Billing section of your account.
You may cancel your subscription at any time from the Billing section of your account or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused portions of a billing period, except where required by law.
We reserve the right to change our pricing with 30 days’ advance notice. Continued use after the effective date of a price change constitutes acceptance.

Kinloop and its content (excluding your data) are owned by sistemafusion, LLC and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the service for your personal, non-commercial care management purposes.
You retain all ownership rights to your data. By using Kinloop, you grant us a limited license to process your data solely to provide and improve the service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.
SISTEMAFUSION, LLC (OPERATING AS KINLOOP) DOES NOT GUARANTEE THAT SMS MESSAGES WILL BE DELIVERED, THAT ALERTS WILL REACH CAREGIVERS IN ANY SPECIFIC TIMEFRAME, OR THAT ANY HEALTH OUTCOME WILL RESULT FROM USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SISTEMAFUSION, LLC (OPERATING AS KINLOOP) AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD 100).
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless sistemafusion, LLC (operating as Kinloop) and its officers, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your infringement of any third-party rights.
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by requesting deletion from your dashboard. Upon termination, your right to use the service ceases immediately.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive your right to participate in a class action or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
We may revise these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Your continued use of Kinloop after the effective date of revised Terms constitutes your acceptance.
